Mediation is an alternative dispute resolution process that provides an opportunity for two parties to solve a problem outside of court with a neutral third party. Mediation is more economical and time-efficient than the court process if handled appropriately. Mediators help both parties create a solution that is satisfactory to them, and these solutions are agreed on by both parties and documented in a written memorandum of understanding. Mediators are unbiased individuals who do not give legal opinions or make decisions about legal outcomes.
At SageDCM, our mediators usually consult individually with each party to assess the case/problem and determine if it is appropriate for the mediation process. If the case is appropriate, we set up a meeting for both parties with the mediator. The mediator listens carefully to the interests of both parties and works to ensure that both parties are heard and understood by each other. The mediator reflects back the interests of both parties and the options for resolving the problem that both parties have identified.
Our mediation services can be used to resolve a range of issues, including workplace issues such as wrongful dismissal, business issues such as breach of contract and ownership of domain names, family issues such as custody and support agreements through open/closed mediation, and child protection issues such as adoption, protection, and placement.
